TERMS AND CONDITIONS OF SALE, RETURNS AND WITHDRAWAL

These Terms and Conditions govern all purchases made through the websites listed above.

Article 2 – Subject Matter of the Contract

These General Terms and Conditions govern distance sales made through the ONYTCG websites of products intended for collecting, gaming and leisure.

By way of example and without limitation, the products sold may include:

  • collectible cards (Trading Card Games – TCG);

  • single cards;

  • booster packs;

  • booster boxes, displays, bundles and Elite Trainer Boxes (ETBs);

  • starter decks, structure decks and sealed products;

  • accessories for trading card games;

  • binders, albums, deck boxes, sleeves, playmats and other accessories;

  • collectible items;

  • gadgets, figures and merchandise;

  • any other products sold by ONYTCG and available on the Website.

The above list is provided for illustrative purposes only and does not limit the categories of products that may be offered for sale on the Website.

Article 3 – Acceptance of the Terms and Conditions

By submitting an order, the Customer declares that they have read, understood and fully accepted these Terms and Conditions of Sale, Returns and Withdrawal, as well as any other policies referred to herein, including, where applicable, the Privacy Policy.

Submitting an order constitutes a contractual offer to purchase the selected products and is subject to acceptance under these Terms and Conditions.

Article 4 – Persons Eligible to Purchase

Purchases through the Website may be made by:

  • consumers;

  • professionals;

  • businesses, companies and organisations;

  • resellers, where expressly authorised by the Seller.

Pursuant to Article 3 of Italian Legislative Decree No. 206/2005 (Italian Consumer Code), a consumer is a natural person acting for purposes unrelated to their business, commercial, craft or professional activity.

A professional is a natural or legal person acting in the course of their business, commercial, craft or professional activity.

The Seller reserves the right to refuse or cancel orders placed by resellers or other commercial operators where they have not been previously authorised or in the circumstances provided for in these Terms and Conditions.

Article 5 – Conclusion of the Contract

The submission of an order by the Customer constitutes an offer to purchase the selected products.

The sales contract is considered concluded when the Customer receives confirmation of the order from ONYTCG by email or another durable medium.

Any automatic acknowledgement of receipt of the order confirms only that the request has been correctly received by the system and does not constitute definitive acceptance of the order in cases involving product unavailability, technical errors, pricing errors, administrative checks or other circumstances preventing proper performance of the contract.

The Seller reserves the right to refuse, cancel or suspend an order, including but not limited to the following circumstances:

  • incomplete, inaccurate or unverifiable Customer information;

  • failed, delayed or impossible payment;

  • suspected fraud or unlawful or unauthorised use of payment methods;

  • material or technical errors relating to price, description or product availability;

  • total or partial unavailability of the products ordered;

  • abusive or fraudulent conduct or conduct contrary to the principles of good faith.

Where the Customer has already made payment, ONYTCG will refund any amounts collected without undue delay, using the same payment method used for the original transaction, unless otherwise agreed with the Customer.

Article 6 – Prices

All product prices are expressed in Euro (€) unless otherwise stated and are those displayed on the Website at the time the order is submitted.

Unless otherwise specified, prices include any VAT applicable under current legislation.

Any shipping costs, taxes, customs duties or other additional charges will be displayed separately during the purchasing process where applicable.

The Seller reserves the right to change product prices at any time without prior notice. Such changes will not affect orders already confirmed, for which the price displayed when the order was submitted will apply.

If, due to a material, technical or IT error, a price is published that is manifestly incorrect, abnormal or disproportionately low compared with the actual value of the product, the Seller reserves the right to cancel the order, promptly inform the Customer and issue a full refund of any amounts already paid.

Article 7 – Product Availability

Product availability displayed on the Website is indicative and does not constitute an absolute guarantee that the product will be available when the order is fulfilled.

Due to simultaneous sales, inventory updates, technical errors, delays in system synchronisation or other circumstances, one or more products may become unavailable even after an order has been confirmed.

If an ordered product becomes totally or partially unavailable, ONYTCG will promptly inform the Customer and, depending on the circumstances, may issue a full or partial refund for the unavailable products.

Where possible, the Customer may also be offered alternative solutions, such as:

  • replacement with an equivalent product;

  • waiting for restocking, where expected;

  • issuance of Store Credit;

  • issuance of an ONYTCG Gift Card.

Replacement, Store Credit and Gift Cards are optional alternatives and require the Customer's acceptance.

Article 8 – Preorders

Certain products may be offered for sale as preorders.

A preorder allows the Customer to purchase in advance a product that is not yet available in stock or has not yet been officially released.

Release, shipping and availability dates communicated by publishers, manufacturers, distributors or other suppliers are estimates and may be changed.

Any changes or delays in product availability may result in the expected shipping date being postponed.

The availability of preorder products may be subject to allocations, limitations, reductions or cancellations of quantities assigned by manufacturers or distributors.

Placing and paying for a preorder does not provide an absolute guarantee of final product availability where limitations or quantity reductions are imposed by the manufacturer or distributor.

Where the quantities allocated are lower than those requested, ONYTCG may:

  • reduce the quantities allocated to individual Customers;

  • fulfil orders according to objective criteria, including the chronological order in which orders were received;

  • fully or partially cancel orders that cannot be fulfilled;

  • issue full or partial refunds for products or quantities that cannot be supplied;

  • offer, subject to the Customer's consent, Store Credit, a Gift Card or an alternative product.

Where a preorder cannot be fulfilled in whole or in part, ONYTCG may cancel the unavailable quantity and issue the corresponding refund using the payment method originally used, without needing to wait for the Customer's acceptance before returning the amount due.

The Customer will be promptly informed of the full or partial cancellation and the initiation of the corresponding refund.

Any offer of Store Credit, a Gift Card, an alternative product or another solution is entirely optional and requires the Customer's acceptance.

Article 9 – Collectible Cards and Sealed Products

Collectible cards and sealed products may present characteristics resulting from the normal manufacturing process, including, by way of example:

  • minor printing imperfections;

  • small surface marks;

  • centering imperfections;

  • slight factory curvature;

  • minor differences in cutting, finish or colour;

  • other manufacturing tolerances generally accepted within the industry.

Where compatible with the manufacturer's quality standards and applicable law, such characteristics do not necessarily constitute a lack of conformity.

Product images displayed on the Website are for illustrative purposes unless expressly stated that actual photographs or scans of the product are being shown.

The random contents of booster packs, boxes, displays, bundles, starter decks or other sealed products are determined exclusively by the manufacturer.

ONYTCG does not guarantee specific cards, rarities, pull rates, numbering, contents or results obtained from opening products.

The consumer's rights under applicable legislation concerning the legal guarantee of conformity remain unaffected.

Article 10 – Payment Methods

ONYTCG provides Customers with the payment methods displayed during the purchasing process.

Available payment methods may change over time and will be those displayed when the order is placed.

By way of example, available payment methods may include:

  • PayPal;

  • credit and debit cards;

  • Stripe;

  • bank transfer;

  • Scalapay;

  • other payment methods that may be made available on the Website.

The Seller reserves the right to add, modify or remove available payment methods.

Orders will be processed and shipped only after payment has been confirmed, unless different conditions apply to the selected payment method.

For payments made by bank transfer, the order will be processed after the amount has actually been credited to the Seller's bank account, unless otherwise agreed.

If payment is rejected, cancelled or not authorised by the payment provider, the order cannot be accepted or fulfilled.

Article 11 – Gift Cards and Store Credit

ONYTCG offers digital Gift Cards and Store Credit that may be used for purchases made through the official ONYTCG websites, unless otherwise stated.

Gift Cards are issued digitally and sent to the email address provided by the Customer.

Gift Cards and Store Credit may be used to purchase both in-stock and preorder products unless otherwise stated.

Credit may be used across one or more orders until the available balance has been fully used.

Unless otherwise stated at the time of issue, Gift Cards and Store Credit do not expire.

Any remaining balance will remain available for future purchases.

Gift Cards and Store Credit cannot be exchanged for cash except where required by applicable law.

The available balance may be viewed by accessing the Customer Account under the “My Credit” section.

Article 12 – Anti-Fraud Checks

To protect both the Customer and the Seller, certain orders may be subject to anti-fraud or administrative checks.

ONYTCG reserves the right to request additional information or documentation necessary to verify the Customer's identity, the legitimacy of the payment or the accuracy of the information provided.

If such checks cannot be successfully completed, or if there are reasonable grounds to suspect fraud, unauthorised use of payment methods or other unlawful activities, the Seller may suspend, refuse or cancel the order and, where necessary, refund any amounts already received.

Article 13 – Shipping and Delivery

ONYTCG ships within Italy and to the countries currently served by its delivery services, using couriers and logistics partners selected by the Seller.

Available destinations, shipping costs, shipping methods and estimated delivery times are displayed on the Website and during the checkout process.

The delivery times shown are estimates and refer to normal transit times after the shipment has been handed over to the courier.

Actual delivery times may vary due to public holidays, high shipping volumes, weather conditions, customs procedures, force majeure events or other circumstances that may affect normal transit times, without prejudice to the consumer's mandatory rights under applicable law.

Upon delivery, the Customer is advised to check the condition of the packaging and the products received.

If the parcel shows visible damage, tampering or other irregularities, the Customer is advised, where possible, to immediately report such circumstances to the courier, preferably by making a specific reservation on the delivery document.

The Customer is also advised to notify ONYTCG of any visible damage within 48 hours of delivery by emailing info@onytcg.it and, where possible, providing photographs of the packaging, shipping label and products received.

The 48-hour period is intended to facilitate the prompt handling of claims with the courier and does not limit or exclude any mandatory consumer rights under applicable law.

Under applicable law, the risk of loss of or damage to the products passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.

Article 14 – Right of Withdrawal

The consumer has the right to withdraw from the purchase contract within 14 days from the day on which they acquire physical possession of the goods, in the cases and according to the procedures provided for by applicable law.

Where an order contains multiple products delivered separately, the withdrawal period begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the last product.

To exercise the right of withdrawal, the consumer may:

  • use the digital function available in the Customer Account under “My Orders”, using the “Withdraw from the contract here” button;

  • send an explicit notice to info@onytcg.it;

  • send written notice to:

The notice must contain the information necessary to identify the Customer and the relevant order.

Where the right of withdrawal is exercised using the digital function, ONYTCG will provide confirmation of receipt on a durable medium without undue delay.

Exercising the right of withdrawal does not affect any other rights granted to the consumer under applicable law.

Article 15 – Return of Products

After receiving the notice of withdrawal, ONYTCG will provide the Customer with operational instructions for returning the products.

Unless otherwise agreed, the Customer must return the products within 14 days from the date on which they communicated their decision to withdraw, in accordance with applicable law.

Products must be appropriately packaged to protect them during transit.

Returned products should:

  • include any accessories, manuals and components supplied;

  • where possible, be returned in their original packaging or otherwise in suitable protective packaging;

  • not have been handled beyond what is necessary to establish their nature, characteristics and functioning;

  • where possible, be accompanied by the relevant order number or reference.

The Customer is responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Simply opening a product's packaging does not automatically result in the loss of the right of withdrawal, unless the product falls within one of the specific exceptions provided for by applicable law.

The exclusions set out in Article 16 remain applicable.

ONYTCG may inspect the condition of returned products for the purpose of determining any diminished value, in accordance with applicable law.

Article 16 – Exclusions from the Right of Withdrawal

The right of withdrawal is excluded in the cases provided for under Article 59 of Italian Legislative Decree No. 206/2005 (Italian Consumer Code) and applicable legislation.

By way of example, the right of withdrawal may not be exercised in cases expressly provided for by law, including:

  • products made to the Customer's specifications or clearly personalised;

  • sealed goods that are not suitable for return for health protection or hygiene reasons and which have been unsealed after delivery;

  • any other goods or services for which applicable legislation expressly excludes the right of withdrawal.

Handling a product beyond what is necessary to establish its nature, characteristics and functioning may result in a reduction in the value of the goods in accordance with applicable law.

The consumer's rights relating to the legal guarantee and lack of conformity remain unaffected.

Article 17 – Return Costs

Unless otherwise provided by applicable law or agreed in writing between the parties, the direct costs of returning products are borne by the Customer.

Return costs will instead be borne by ONYTCG where the return is due to:

  • an error attributable to the Seller;

  • delivery of an incorrect product;

  • a defective or non-conforming product;

  • any other circumstance in which applicable law requires the Seller to bear such costs.

Customers are advised to use a trackable shipping service and appropriate protective packaging when returning products.

Article 18 – Refunds

Where the right of withdrawal is exercised, ONYTCG will issue the refund within the period required by applicable law and, in any event, within 14 days of receiving the notice of withdrawal.

ONYTCG may withhold the refund until the goods have been received or until the Customer provides evidence that the goods have been sent back, whichever occurs first, where permitted under applicable law.

The refund will be made using the same payment method used by the Customer for the original transaction, unless otherwise expressly agreed and provided that this does not result in additional costs for the Customer.

Where required by applicable law, the refund will also include the cost of the standard delivery method. Any additional costs resulting from the Customer's choice of premium, express or optional delivery services will not be refunded beyond the amount corresponding to the applicable standard delivery method.

Alternatively, the Customer may voluntarily choose to receive Store Credit or an ONYTCG Gift Card.

Acceptance of Store Credit or a Gift Card is optional.

Unless otherwise stated at the time of issue, ONYTCG Store Credit and Gift Cards do not expire.

Cancellation Due to Unavailability or Allocation

Where an order or preorder cannot be fulfilled in whole or in part due to product unavailability, allocations lower than the quantities requested, or reductions or cancellations of supplies by the manufacturer or distributor, ONYTCG may cancel the portion of the order that cannot be fulfilled and issue the corresponding refund.

The refund will be made using the payment method originally used, without the need to wait for the Customer's acceptance before returning the amount due.

The Customer will be promptly informed of the cancellation and initiation of the refund.

ONYTCG may offer Store Credit, a Gift Card, an alternative product or another equivalent solution, but such alternatives may only be applied with the Customer's consent.

Under no circumstances will Store Credit, a Gift Card or an alternative product be imposed in place of a refund due to the Customer.

Article 19 – Legal Guarantee of Conformity

Consumers benefit from the legal guarantee of conformity provided for under applicable Italian and European legislation.

In the event of a lack of conformity, the consumer will be entitled to the remedies provided for under applicable law, including, where the relevant conditions are met:

  • repair;

  • replacement;

  • proportionate price reduction;

  • termination of the contract and consequent refund.

Rights arising from the legal guarantee remain unaffected and are not limited by these General Terms and Conditions of Sale.

Article 20 – Limitation of Liability

Without prejudice to the mandatory rights granted to consumers under applicable law, ONYTCG will not be liable for events not directly attributable to the Seller, including:

  • force majeure events or unforeseen circumstances;

  • temporary interruptions or malfunctions of the Website, IT systems or payment services not attributable to ONYTCG;

  • delays or disruptions resulting from external circumstances, without prejudice to any obligations and liabilities imposed on the Seller by applicable law.

Nothing in this Article is intended to exclude or limit any liability that cannot legally be excluded or limited.

The consumer's mandatory rights remain unaffected.

Article 21 – Intellectual Property

All trademarks, logos, images, photographs, texts, descriptions, graphics, videos and other content displayed on the Website belong to their respective owners or are used by ONYTCG under licence, authorisation or another lawful basis.

Any reproduction, distribution, modification, publication or use of such content without the prior authorisation of the lawful owner is prohibited, except where permitted by law.

Article 22 – Privacy

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR), applicable national legislation and the Privacy Policy published on the Website.

For further information, Customers are invited to consult the Privacy Policy available on the Website.

Article 23 – Applicable Law and Dispute Resolution

These General Terms and Conditions of Sale are governed by Italian law, without prejudice to any mandatory rights granted to consumers under applicable legislation.

For disputes relating to contracts concluded with consumers, the mandatory rules governing territorial jurisdiction under applicable law shall apply.

Before commencing legal proceedings, the Customer is invited to contact ONYTCG at info@onytcg.it in order to attempt an amicable resolution of the dispute.

Article 24 – Digital Withdrawal Function

ONYTCG provides consumers with a digital function dedicated to exercising the right of withdrawal, accessible from the Customer Account under “My Orders” via the “Withdraw from the contract here” button.

This function allows consumers to submit their withdrawal request directly online.

Following submission of the request, the consumer will receive confirmation of receipt on a durable medium, such as email, without undue delay.

Use of the digital withdrawal function is an additional method of exercising the right of withdrawal and does not restrict the consumer's ability to exercise that right by email or through any other method permitted by applicable law.
