TERMS AND CONDITIONS OF SALE, RETURNS AND WITHDRAWAL

These Terms and Conditions apply to sales made through the following domains:

2. Subject of the Contract

These conditions govern the online sale of products related to collecting and gaming, including but not limited to:

  • TCG collectible cards

  • Single cards

  • Booster packs

  • Sealed boxes

  • ETB, displays, bundles

  • Gaming accessories

  • Sealed products

  • Collectible items

3. Acceptance of the Conditions

By placing an order, the customer declares that they have read, understood and fully accepted these Terms and Conditions.

4. Eligible Purchasers

Purchases may be made by:

  • Private consumers

  • Companies

  • Professionals

  • Resellers, subject to seller approval where necessary

A consumer is a natural person who purchases for purposes unrelated to their business, commercial, craft or professional activity.

5. Conclusion of the Contract

The contract is considered concluded when the customer receives order confirmation by email or through the automatic system confirmation.

Any automatic order receipt confirmation does not constitute final acceptance in cases of product unavailability, technical error or administrative checks.

The seller reserves the right to refuse, cancel or suspend orders in the following cases:

  • incomplete or incorrect data

  • non-payment

  • suspected fraudulent use

  • technical pricing error

  • product unavailability

  • abusive customer behaviour

In such cases, any amounts already paid will be refunded.

6. Prices

All prices are expressed in Euro (€), unless otherwise stated.

Prices may be changed at any time; the price published at the time of the order shall apply.

In the event of an obvious, abnormal or manifestly incorrect price, the seller may cancel the order with an immediate refund.

7. Product Availability

Product availability is indicative and does not constitute an absolute guarantee of stock.

Simultaneous sales, inventory errors or delayed synchronisations may result in unavailability after the order has been placed.

In such cases, the customer may choose between:

  • full refund

  • replacement with an equivalent product

  • waiting for restock

  • agreed store credit or voucher

8. Pre-orders

Some items may be sold as pre-orders.

Release dates communicated by publishers, manufacturers or distributors are indicative and may change.

The seller is not responsible for official postponements, logistical delays or quantity reductions assigned by distributors.

In the event of lower-than-expected allocation, ONYTCG may:

  • reduce purchasable quantities

  • fulfil orders in chronological order

  • offer a full or partial refund

9. Collectible Cards and Sealed Products

Collectible cards may present:

  • normal production tolerances

  • minor printing defects

  • micro surface marks

  • centering imperfections

  • slight factory curvature

  • minor differences in cut or finish

These characteristics, where compatible with industry standards, do not constitute a defect.

Product images are indicative unless expressly stated as an actual scan of the product.

The random content of packs, boxes or sealed products depends exclusively on the manufacturer.

The seller does not guarantee pull rates, specific rarities or specific contents.

Subjective grading evaluations do not constitute grounds for return.

10. Payment Methods

The following payment methods are accepted:

  • PayPal

  • Credit/debit cards

  • Bank transfer

  • Scalapay

  • Satispay

The order may be shipped only after payment confirmation, except for systems with immediate authorisation.

11. Anti-fraud Checks

For the protection of both the customer and the seller, some orders may be subject to manual checks.

The seller may request confirmation of data or cancel suspicious orders.

12. Shipping and Delivery

Shipping is mainly carried out through:

  • UPS

  • BRT

The seller may also use other equivalent couriers.

Shipping times and costs are shown during checkout.

Delivery times are indicative and may vary due to causes not attributable to the seller.

The customer must check the integrity of the package upon delivery.

Any visible damage must be immediately reported to the courier and communicated within 48 hours to info@onytcg.it.

The risk of loss or damage to the products transfers to the consumer upon delivery.

13. Right of Withdrawal

Consumers residing in the European Economic Area have the right to withdraw from the contract within 14 days of receiving the goods, without having to provide any reason.

For multiple orders delivered separately, the withdrawal period starts from receipt of the last item.

To exercise the right of withdrawal, it is sufficient to send an explicit communication within the required deadline to:

14. Return of Products

After communicating the withdrawal, the customer must return the products within 14 days.

Returned products must be:

  • intact

  • complete with accessories

  • properly packaged

  • not used beyond what is necessary to verify their nature and characteristics

  • accompanied, where possible, by the order reference

For sealed products such as booster boxes, displays, starter decks, bundles and similar items, returns are accepted only if the products are still sealed and intact, except where opening is necessary to verify any lack of conformity.

15. Exclusions from Withdrawal

The right of withdrawal may be excluded in cases provided by law, including:

  • personalised or custom-made products

  • opened sealed products where excluded under applicable law

  • goods damaged by the customer

  • incomplete products

  • items used beyond normal inspection

The consumer’s rights in the event of lack of conformity remain unaffected.

16. Return Costs

Return shipping costs are borne by the customer, except in cases of:

  • seller error

  • incorrect product

  • defective or non-compliant product

  • different written agreement

Tracked shipping is recommended.

ONYTCG is not responsible for lost returns without tracking.

17. Refunds

Once the return has been received and verified as compliant, the refund will be issued within 14 days.

The seller may withhold the refund until receipt of the goods or until the customer has provided proof of return shipment, whichever occurs first.

The refund will be made using the same payment method used for the purchase, unless otherwise agreed.

The following will be refunded:

  • the price of the returned product

  • the original standard shipping costs, where required by law

Any additional costs relating to premium, express or optional services chosen by the customer will not be refunded.

18. Legal Guarantee

For consumers, the legal guarantee of conformity provided by applicable Italian and European law applies.

In the event of a lack of conformity reported within the legal terms, the customer may be entitled, where applicable, to:

  • repair

  • replacement

  • price reduction

  • refund

19. Limitation of Liability

The seller is not liable for:

  • delays attributable to couriers

  • force majeure events

  • temporary platform unavailability

  • indirect damages or loss of profits not caused by wilful misconduct or gross negligence

Mandatory consumer rights remain unaffected.

20. Intellectual Property

Trademarks, images, logos, texts and website content belong to their respective owners.

Unauthorised reproduction is prohibited.

21. Privacy

Personal data are processed according to the Privacy Policy published on the website, in compliance with the GDPR and applicable legislation.

22. Applicable Law and Disputes

The contract is governed by Italian law.

For any dispute relating to contracts concluded with consumers, the court of the consumer’s place of residence or domicile shall have jurisdiction, if located in Italy.

The customer is invited to contact the seller beforehand at info@onytcg.it in order to seek an amicable solution.
